TERMS AND CONDITIONS ON DEPOSIT & NO-SHOW FEE

1. Application of These Terms

• These Terms & Conditions apply to all bookings at Kuro Sakura Japanese BBQ (“We”, “Us”, “Our”, or “Our Restaurant”) that require a deposit or may incur a no-show fee.

• By making a booking, you confirm that you have read, understood, and agree to these Terms & Conditions.

2. No-Show Fees

• If a no-show fee applies to your booking:

  • Cancellation within 24 hours of the booked time: the no-show fee specified during the booking process will be charged.

  • Cancellation more than 24 hours before the booked time: no no-show fee will be charged.

• A “no-show” means you do not attend the reservation without giving notice or cancelling.

• No-show fees are charged in accordance with the Australian Consumer Law (ACL) as fair compensation for loss caused by late cancellations or non-attendance.

3. Deposits

• Where a deposit is required, payment must be made using one of the following approved methods:

  • Payment through the online booking flow

  • Bank transfer

  • EFTPOS or cash paid in person at the venue

• A booking is not confirmed until the required deposit has been received.

• Deposits are credited toward the final bill during your visit. Only the remaining balance is payable.

• If you pay your full bill in cash, the entire deposit may be refunded on the day of your visit.

4. Deposit Refunds, Credits & Forfeiture
In accordance with the Australian Consumer Law:

• Cancellation more than 7 days before the booking time

  • The deposit is fully refundable.

• Cancellation between 24 hours and 7 days before the booking time

  • The deposit is non-refundable, but may be converted to store credit for future use at our restaurant.

  • Credits have no expiry date.

• Cancellation within 24 hours of the booking time

  • The deposit is forfeited as a cancellation fee.

  • It cannot be refunded or converted to credit.

• Genuine Pre-Estimate of Loss

  • All cancellation fees represent a genuine pre-estimate of loss incurred by the venue due to late cancellations, including lost revenue, allocated staffing, and reservation holding costs.

  • This aligns with ACCC and NSW Fair Trading guidelines.

5. Surcharges

• A 2% payment processing fee applies to online payments.

• A 1.5% card surcharge applies to payments made via our EFTPOS terminal.

• All surcharges comply with the Reserve Bank of Australia’s standards and reflect the actual cost of card acceptance.

6. Events Beyond Our Control (Force Majeure)

• If an event outside our reasonable control impacts your booking or our ability to operate (e.g., severe weather, power outages, staff shortages, emergencies, government restrictions), we may:

  • Refund the deposit,

  • Offer an alternative booking time, or

  • Issue store credit.

• Decisions will be made fairly and reasonably under the Australian Consumer Law.

7. Australian Consumer Law (ACL) Rights

• Nothing in these Terms & Conditions excludes or limits your rights under the Australian Consumer Law.

• These terms apply only to the extent permitted by law.

8. Amendments

• We may update these Terms & Conditions from time to time.

• The version in effect at the time your booking was made will apply to your reservation.

All-You-Can-Eat & All-You-Can-Drink

1. When dining at Kuro Sakura Japanese BBQ (“We”, “Us”, “Our”, or “Our Restaurant”), you are permitted to make multiple orders for food and drinks after being seated and the dining time has commenced.

2. Dining time is limited to 90 minutes from the start of your booking time, last orders must be placed before 60 minutes lapse. It is your responsibility to ensure that you promptly arrive at your allocated time.

3. Guests dining together on the same table must agree upon the same All-You-Can-Eat and All-You-Can-Drink packages, unless We allow otherwise.

4. In the case of food leftovers more than 100g, an additional charge of $15/100g of uneaten food will apply (including cooked leftovers) as a reasonable measure to prevent unnecessary food wastage.

5. Order cancellations are usually not possible due to our strict food quality and safety control procedures; however, we will permit cancellations where it is reasonably practicable to do so to ensure there is no risk of food wastage. Please do not send duplicate orders as it slows down services and causes over ordering.

6. You must only order what you can reasonably consume, and you may not take-away leftover food unless we agree otherwise.

7. We strictly abide by the Responsible Service of Alcohol (RSA) rules when providing drinks in the All-You-Can-Drink menu and will deny service of alcohol to all minors and those of individuals who appear intoxicated.

8. Kuro Sakura Japanese BBQ reserves the right to amend the All-You-Can-Eat & All-You-Can-Drink offer at its sole discretion without prior notice.

The printed T&Cs are the same as the T&Cs on our ordering software. You acknowledge that we have taken all reasonable measures to inform you of our T&Cs, and that progressing past the T&Cs page on the software and placing an order constitutes your acceptance of our T&Cs.

Due to the large volume of orders our staff regularly attend to during business hours, We have taken all reasonable measures to ensure that you are provided with Our Terms and Conditions, and We cannot accept any failure by you to read our Terms and Conditions as a reason to dispute our services and charges.
